Welcome to Value WordPress Designs. By engaging our services, you agree to the following terms and conditions. Please read them carefully.


1. Scope of Work

The scope of work for each project is outlined in the initial project proposal or quote. This scope includes specific design elements, functionalities, and timelines based on client requirements. Any additional requests beyond the defined scope may be subject to additional fees, which will be communicated before proceeding.

2. Client Responsibilities

Content Submission: Clients are responsible for providing accurate and complete content for their websites unless otherwise agreed. If content is not provided, AI-generated content may be used; however, please note that we do not offer dedicated copywriting services.

Website Maintenance: For clients who purchase maintenance services, we will perform regular updates and backups. However, should issues arise during maintenance due to plugin or platform updates, troubleshooting may be required, which may incur additional charges.

Timely Communication: Clients agree to respond promptly to requests for information or feedback to ensure the project stays on schedule.

3. Revision Policy

Revisions are detailed within each package and include a set number of revision rounds to ensure your vision is achieved while respecting project boundaries:

  • New Website Package: 3 revisions (1 major, 2 minor)
  • Website Revamp Package: 2 revisions (1 major, 1 minor)
  • Maintenance Packages: 1 minor revision

Minor Revisions include text edits, small design tweaks, or color changes. Major Revisions include layout changes, adding/removing sections, or anything affecting structure/functionality.

Additional revisions beyond the included rounds may incur extra charges, with fees communicated and agreed upon before further work.

4. Timeline and Delays

Estimated project timelines are provided in your proposal. Timely cooperation from both sides is essential to meet deadlines. Delays in providing content, feedback, or approvals may result in adjusted timelines or additional fees. We aim to deliver on time but cannot be held liable for delays caused by external factors.

Inactivity Clause: If we do not receive required content or feedback within 14 days of our last communication, your project may be placed on hold and rescheduled based on availability.

  • Projects paused due to no feedback or content after 14 days will be rescheduled based on availability.

  • Projects inactive for 30 days or more may be considered closed.

  • Restarting a closed project will require a new start date and project completion date, plus a restart fee of 25% of the total project cost (minimum R1,500).

  • Restart fees cover rescheduling, file retrieval, and required updates.

5. Third-Party Tools and Services

Our services may incorporate third-party tools, plugins, or integrations. We are not responsible for issues arising from these third-party services. Clients are advised to review the terms and conditions of these providers.

6. Support Post-Project Completion

Each package includes a defined period of post-launch support for minor adjustments. The scope and duration of this support are stated in your proposal. Extended support packages are available for ongoing assistance.

7. Privacy and Data Collection

We collect only necessary data for communication and service delivery. By using our forms, you consent to the collection of your name, telephone number, and email address. You may receive promotional content, which you can unsubscribe from at any time.

8. Analytics and Tracking

We use analytics tools including cookies, session storage, and other technologies to understand user behavior and serve targeted ads (e.g., Facebook).

9. Pricing and Quotes

Our packages are displayed as products and include detailed inclusions and exclusions. Pricing is based on the selected package. Any additional services requested outside of these packages will be quoted separately after evaluation.

10. Payments

Payments must follow the agreed schedule in your quote. Services may be paused or terminated if payments are missed. Additionally, the website will be built on a staging domain under the Value WordPress Designs domain until final payment is made. Once payment is completed, the site will be transferred to the client’s domain.

11. Refund Policy

Deposits are typically non-refundable once work begins. Refunds, if applicable, are prorated based on completed work. For detailed terms, refer to our Refund Policy.

12. Hosting and Domain Registration

We assist with third-party hosting and domain setup but do not provide these services directly. We are not liable for issues related to these third-party providers.

13. Data Backup and Security

While maintenance may include backups, clients remain ultimately responsible for data security and backup practices.

14. Intellectual Property

All content and designs remain the property of Value WordPress Designs until full payment is made. Unauthorized use is prohibited.

15. Indemnity Clause

Clients confirm that all content provided is legal and does not infringe third-party rights. You agree to indemnify Value WordPress Designs from any legal issues arising from client-provided content.

16. AI-Generated Content

If content is generated using AI due to lack of client submission, we are not responsible for its accuracy or copyright compliance. Clients should review all content before launch.

17. Termination

Either party may terminate the agreement. Deposits are non-refundable in client-initiated terminations. In case of breach or non-payment, we reserve the right to terminate services.

18. Liability

We are not liable for indirect or consequential damages related to our services or third-party tools (e.g., hosting, plugins, payment gateways).

19. Portfolio & Marketing Rights

We reserve the right to showcase completed projects, including design elements, screenshots, and links, as part of our portfolio and marketing materials (such as our website, social media, and promotional campaigns). Sensitive or proprietary information will not be disclosed.

20. Governing Law

These Terms are governed by the laws of South Africa. Disputes shall be resolved under the jurisdiction of the courts in Cape Town.

21. Force Majeure

We are not liable for delays caused by circumstances beyond our control, including but not limited to natural disasters, pandemics, war, or government restrictions.

22. Communication

We operate fully online. All official communication is handled via email. Clients may also contact us via WhatsApp or request a callback.

23. Changes to Terms

We may amend these Terms at any time. Continued use of our services after updates constitutes acceptance of the revised terms.
